User Agreement

1. Eligibility and User Accounts

1.1 Eligibility

You may use the Services only if you are legally capable of entering into a binding agreement under the laws applicable to you. If you are under the age of legal majority in your jurisdiction, you may use the Services only with the consent and supervision of a parent or legal guardian.

1.2 Registration and Login

Certain features may require you to create and log in to an account. You agree to provide accurate, complete, and current information and to keep that information updated. Information associated with your account will be handled in accordance with our Privacy Policy.

1.3 Account Security

You are responsible for maintaining the confidentiality and security of your account credentials and for activities conducted through your account. You must promptly notify us if you become aware of any unauthorized access to or use of your account.

1.4 Account Deletion

You may request deletion of your account through the App, where this functionality is available, or by contacting us. After your account is deleted, your personal information and account data may be permanently erased and may not be recoverable, except where retention is required or permitted by applicable law or described in our Privacy Policy.

2. The Services

2.1 AI-Powered Features

Orinqela AI may provide artificial intelligence-powered tools that allow you to submit text, images, audio, video, prompts, or other materials (“Input”) and receive generated or processed text, images, audio, video, suggestions, or other results (“Output”). Features may be added, modified, limited, or removed over time.

2.2 AI Output

Artificial intelligence and machine-learning technologies are probabilistic and may produce Output that is inaccurate, incomplete, misleading, offensive, or unsuitable for your intended purpose. Similar or identical Output may also be generated for other users.

You are responsible for reviewing and evaluating Output before using, publishing, sharing, or relying on it. You must not rely on Output as a substitute for professional legal, medical, financial, or other qualified advice. You are solely responsible for determining whether your use of any Output complies with applicable laws and third-party rights.

2.3 Availability and Changes

We do not guarantee that any particular feature or Output will always be available. We may introduce usage limits, technical restrictions, or eligibility requirements and may modify, suspend, or discontinue all or part of the Services where permitted by applicable law.

3. User Content and Output Rights

3.1 Your Input

You retain any rights you have in your Input. You represent and warrant that you have all rights, licenses, consents, and permissions necessary to submit your Input and allow us to process it as described in this Agreement and our Privacy Policy.

You grant Orinqela AI a worldwide, non-exclusive, royalty-free license to host, reproduce, process, transmit, modify, and display your Input solely as necessary to operate, maintain, secure, and provide the Services and to comply with applicable law. Our collection and use of Input and related data are further described in our Privacy Policy and any settings made available within the Services.

3.2 Your Output

As between you and Orinqela AI, and to the extent permitted by applicable law, you retain any rights you may have in Output generated specifically for you. Because laws concerning AI-generated content continue to develop, we do not guarantee that any Output is eligible for copyright, ownership, exclusivity, or other legal protection.

Your rights in Output do not extend to elements owned by Orinqela AI or third parties, including trademarks, copyrighted materials, software, interfaces, or other protected content that may appear in or relate to the Output.

3.3 Responsibility for Content

You are solely responsible for your Input and your use of Output. We may remove or restrict access to content that we reasonably believe violates this Agreement, applicable law, or the rights or safety of others.

4. Subscriptions and Payments

4.1 Free and Paid Services

The App may provide free, advertising-supported, credit-based, one-time-purchase, or subscription-based features. The price, included benefits, usage limits, billing interval, renewal terms, and applicable taxes will be displayed before you complete a purchase.

4.2 Subscriptions

Subscription fees may be charged through your Google Play account, Apple App Store account, or another payment provider identified at checkout. Unless otherwise stated at the time of purchase, subscriptions automatically renew for the same subscription period until canceled. The payment provider may charge your selected payment method at the beginning of each renewal period.

4.3 Cancellation

You may cancel a subscription through the subscription-management settings of Google Play, the Apple App Store, or the applicable payment provider. Cancellation takes effect at the end of the current billing period, and you will retain access to the applicable subscription benefits until that period ends unless otherwise stated.

4.4 Refunds

Except where required by applicable law, payments are non-refundable and no credits or refunds are provided for partially used subscription periods, unused credits, or accidental purchases. Purchases made through Google Play or the Apple App Store are also subject to the applicable store’s billing and refund policies.

4.5 Advertisements

Free or partially free versions of the Services may display advertisements supplied by third parties. Orinqela AI does not endorse or guarantee the accuracy, legality, availability, or quality of third-party advertisements, products, or services.

5. Acceptable Use

You agree not to use the Services to:

• violate any applicable law, regulation, court order, or third-party right;
• create, upload, request, distribute, or promote illegal, fraudulent, defamatory, abusive, harassing, hateful, sexually exploitative, or otherwise harmful content;
• infringe or misappropriate copyrights, trademarks, privacy rights, publicity rights, confidential information, or other rights;
• impersonate another person, misrepresent the origin of content, deceive others, or facilitate fraud or manipulation;
• generate or distribute malware, malicious code, spam, unauthorized advertising, or other disruptive material;
• exploit, harm, or attempt to identify minors or other vulnerable individuals;
• gain unauthorized access to accounts, systems, networks, models, or data;
• interfere with, overload, disrupt, bypass, or compromise the operation, security, safeguards, or usage limits of the Services;
• reverse engineer, decompile, extract, scrape, or attempt to discover source code, model components, model weights, or underlying systems, except where such restrictions are prohibited by law;
• use automated means to access or collect data from the Services without our written permission; or
• use the Services or Output to develop, train, or improve a competing artificial intelligence model or service without our written permission.

6. Intellectual Property

The Services, including their software, source code, models, algorithms, interfaces, designs, text, graphics, logos, trademarks, templates, and other materials provided by Orinqela AI, are owned by or licensed to Orinqela AI and are protected by intellectual property laws.

Subject to your compliance with this Agreement, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Services for their intended purposes. No rights are granted to you except those expressly stated in this Agreement.

7. Privacy

Your use of the Services is subject to our Privacy Policy. Please read it carefully to understand how we collect, use, store, share, and protect personal information, including information contained in Input and generated through your use of the Services.

8. Third-Party Services

The Services may contain links to, integrate with, or depend on third-party platforms, content, software, models, payment processors, or services. Your use of third-party services may be governed by separate terms and privacy policies. We are not responsible for the availability, accuracy, security, or practices of third-party services.

9. Suspension and Termination

You may stop using the Services at any time. We may suspend, restrict, or terminate your account or access to all or part of the Services if we reasonably believe that you have violated this Agreement, created risk or legal exposure, failed to pay applicable fees, or threatened the rights, safety, security, or operation of Orinqela AI, our users, or third parties.

Upon termination, your right to use the Services ends immediately. Provisions that by their nature should survive termination—including provisions concerning intellectual property, payment obligations, disclaimers, limitations of liability, and dispute terms—will remain in effect.

10. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Services and all Output are provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory. We disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Services or Output will be accurate, complete, unique, uninterrupted, secure, error-free, or suitable for your needs, or that defects will be corrected. Your use of the Services and reliance on Output are at your own risk.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Orinqela AI and its affiliates, officers, employees, agents, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business opportunities, goodwill, use, or data arising out of or relating to the Services or this Agreement.

To the maximum extent permitted by applicable law, the total liability of Orinqela AI for all claims arising out of or relating to the Services or this Agreement will not exceed the greater of: (a) the amount you paid to Orinqela AI for the Services during the twelve months immediately before the event giving rise to the claim; or (b) USD 50.

Nothing in this Agreement excludes or limits liability that cannot lawfully be excluded or limited.

12. Changes to this Agreement

We may revise this Agreement from time to time. Where required by applicable law, we will provide notice of material changes. The updated Agreement will state its new effective date. If you do not agree to the revised Agreement, you must stop using the Services. Your continued use of the Services after the revised Agreement becomes effective constitutes acceptance of the revised Agreement.

13. Governing Law and Dispute Resolution

This Agreement is governed by applicable law, without regard to conflict-of-laws rules. Any dispute arising out of or relating to this Agreement or the Services will be resolved by a court or other dispute-resolution process having jurisdiction under applicable law, unless mandatory consumer-protection law provides otherwise.

14. General Terms

If any provision of this Agreement is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver of our right to do so later. You may not assign or transfer this Agreement without our prior written consent. We may assign this Agreement as part of a merger, acquisition, corporate reorganization, or sale of assets, or by operation of law.

This Agreement, together with the Privacy Policy and any additional terms presented for specific features or purchases, constitutes the entire agreement between you and Orinqela AI concerning the Services.
